Jurisdiction In Criminal Cases

The Elko Municipal Court has jurisdiction to hear misdemeanor cases through arraignment and/or trial and imposition of sentence. NRS 5.050(2). The Elko Justice Court has jurisdiction to hear misdemeanor cases through arraignment and/or trial and imposition of sentence, and felony and gross misdemeanor cases through a preliminary hearing. • In criminal cases generally, the jurisdiction of the Elko Justice Court extends to the boundaries of Elko County. NRS 4.370(4). • In a criminal case involving an arrest made by a member of the Nevada Highway Patrol, the jurisdiction of the Elko Justice Court extends to the boundaries of Elko County, and to the boundaries of all counties having a common boundary with Elko County. NRS 4.370(5).
